Advocacy Correspondence: Pennsylvania House of Representatives, HAP Opposition to House Bill 1925

Members of the Pennsylvania House of Representatives:
On behalf of more than 235 member hospitals and health systems, The Hospital and Healthsystem Association of Pennsylvania (HAP) writes in opposition to House Bill 1925 (Venkat) expected to receive third and final consideration as early as Wednesday, September 30.
House Bill 1925 is a timely and well-intended legislation, seeking to increase patient awareness of the use of artificial intelligence (AI) across the health care industry. However, it falls short in reflecting the technology’s evolving use across the health care continuum, does not take into consideration federal requirements taking shape, or the standardization efforts across industries.
HAP acknowledges and appreciates the collaboration from the prime sponsor and committee staff in engaging the hospital community and positively revising language throughout the legislative process, but significant concerns remain unresolved in the proposal:
- Disclosure: The bill’s broad disclosure requirements will impose heavy administrative burdens with frequent notices that are unlikely to meaningfully inform and rather may confuse patients.
- Responsible Use: The bill does not recognize FDA-approved AI tools or treat HIPAA compliance as satisfying requirements, creating duplication with federal law.
- Oversight and Third-Party Vendors: Hospitals would be inappropriately held accountable and legally responsible—thereby likely subject to penalties—for third-party vendor AI tools without a workable framework for what that oversight requires.
- Enforcement and Penalties: The oversight process would benefit from a streamlined and simplified approach (advanced notice of violations, grace periods, and corrective action plans) and limiting exposure under the Unfair Trade Practices and Consumer Protection Law.
Pennsylvania hospitals remain committed to the responsible, transparent, and clinically appropriate use of AI. However, this bill imposes ridged requirements and significant penalty exposure creating administrative and legal burdens without clear patient benefit or a workable compliance framework—at a time when hospitals are calling for regulatory simplification and financial relief.
The hospital community is unable to support HB 1925 in its current form but remains committed to working with policymakers on a balanced, practical, and future-focused legislative approach.
HAP respectfully urges members of the Pennsylvania House of Representatives to vote no on House Bill 1925.
