During this program, our presenters will discuss how litigants and government investigators are focused on exploiting the informality and ambiguity of electronic communications to make their case. They will also explain how the sheer volume of electronic data can often overwhelm even the largest companies, with a tsunami of expense from electronic discovery.

Program Overview

“Look at the email” has become a rallying cry for the weaponization of electronic communications for politicos of all stripes. However, when litigation or government investigations arise, electronic communications also present staggering risks for hospitals and health systems. Unfortunately, these risks are often left entirely unchecked until it’s too late. 

Our speakers will provide concrete, practical steps that hospitals and health care systems can take to quell the risks posed by electronic communications in the litigation and government investigation context.

Program Objectives

At the conclusion of this session, the participants will be able to:

  1. Identify and discuss the risks posed by the informality of electronic communications (emails, texts, and social media) in the context of litigation and government investigations.
  2. Identify and discuss the risks posed by the volume of electronic communication data driving the costs associated with electronic discovery in the context of litigation and government investigations.
  3. Provide concrete recommendations so that hospitals and health systems can take immediate action to address these risks.

Faculty

Aaron Danzig is a partner in Arnall Golden Gregory's Health Care, Government Investigations, and Litigation Groups. His practice focuses on representing individuals and corporations in government investigations, including False Claims Act cases and white-collar criminal defense matters. He previously was an Assistant United States Attorney for the Northern District of Georgia.

Scott Wandstrat is a partner in Arnall Golden Gregory’s Healthcare, Government Investigations, and Litigation Groups. He is also the chair of the Electronic Discovery Practice. An unapologetic nerd, Scott enjoys a well-earned, national reputation as a “go-to” lawyer for electronic discovery issues.

Fee includes handout materials forwarded via email prior to the session.

Registration Cancellation Policy

No refunds will be issued for cancellations received after November 29. There is a $25 administrative fee on all cancellations. Cancellations must be received in writing.

The registration deadline is November 28.

Certificate of Attendance

A general certificate of attendance will be emailed to all participants. Some national, state, and local licensing boards and professional organizations will grant continuing education credits for attendance when you submit the course outline and your certificate of attendance. It is recommended you contact your own board or organization to find out what is required.

How the Webinar Will Work
